Terms and Conditions

1.1 These general terms and conditions apply to all agreements between Phoenix Creations and the customer concerning the purchase and delivery of products via the Phoenix Creations webshop. By placing an order, the customer agrees to these general terms and conditions.

 

Orders

2.1 Placing an order via the Phoenix Creations webshop constitutes a binding offer from the customer to purchase the specified products.

2.2 Phoenix Creations reserves the right to reject or cancel an order without providing reasons. In such a case, Phoenix Creations will promptly inform the customer and refund any payments made.

 

Prices and Payment

3.1 All prices on the Phoenix Creations webshop are stated in the applicable currency and include VAT unless otherwise specified.

3.2 Payments can be made using the payment methods available on the Phoenix Creations webshop. Phoenix Creations reserves the right to refuse certain payment methods.

3.3 Phoenix Creations reserves the right to change prices on the webshop at any time. The prices displayed at the time of ordering, however, are binding for the customer.

3.4 Custom-made designs require a 60% deposit of the total purchase amount before the order is confirmed and enters the production phase.

 

Delivery

4.1 Phoenix Creations will make reasonable efforts to deliver the ordered products within a reasonable timeframe.

4.2 Delivery times may vary depending on product availability and other circumstances. Phoenix Creations will inform the customer of any delays in delivery. Phoenix Creations is not responsible for delays caused by the transportation companies.

4.3 Phoenix Creations will meticulously pack the headpieces to minimize the risk of damage during transportation. Despite these precautions, if the item becomes damaged during transit, please contact us  within 24 hours upon receipt and provide photos of the package's conditions. Without this evidence, we regrettably cannot offer compensation.

4.4 The risk of loss or damage to the products transfers to the customer upon delivery.

 

Returns

5.1 Unfortunately, headpieces cannot be returned. Before dispatch, a comprehensive quality check is conducted, and a photo of the item is taken as proof that it was sent in good condition. Phoenix Creations is not responsible for any damage during transport. In case of damage during transport and if the customer contacts us within 24 hours of receipt, as mentioned in paragraph 4.3, Phoenix Creations is open to consider compensation possibilities, but it is not mandated to provide compensation in every case.

 

Intellectual Property

6.1 All intellectual property rights related to the webshop, including but not limited to texts, images, logos, and trademarks, remain the property of Phoenix Creations or the respective owners.

6.2 The customer is not permitted to copy, reproduce, distribute, or use material from the webshop in any way without permission from Phoenix Creations.

 

Liability

7.1 Phoenix Creations is not liable for direct or indirect damages arising from the use of the webshop or the purchased products, unless there is intent or gross negligence.

7.2 The liability of Phoenix Creations is at all times limited to the amount charged for the respective order.
